Extension of the validity of FCRA registration certificates

Background

FCRA or Foreign Contribution Regulation Act is an act in the Indian Parliament associated with the regulation of foreign contributions to the individuals and organizations in India. According to FCRA, any non-government organization or association willing to accept donations or funds from foreign sources must register with the Ministry of Home Affairs. The certificate for registration remains valid for five years after which it should be renewed.

Public Notice

The Ministry of Home Affairs vide public notice No. II/21022/23(22)/2020-FCRA-III, dated 24 March, 2022 has stated that the validity of entities registered under Foreign Contribution (Regulation) Act whose 5-year validity period

  • was already extended till March 31, 2022 vide public notice dated 31 December, 2021; or
  • is expiring between April 1, 2022 – June 30, 2022 will stand extended till June 30 or till the date of disposal of renewal application, whichever is earlier.

The validity as per above notice shall stand extended only if entities have applied for renewal before the expiry of the registration.

The order further provided that in case of refusal of the application for renewal of registration, the validity of the certificate shall be deemed to have expired on the date of refusal of the application and the association or the NGO shall not be eligible either to receive the foreign contribution or utilize the foreign contribution received.
