Amendment in Rule 12 of Companies (Accounts) Rules, 2014 regarding filing of AOC- 4 by NBFCs

Ministry of Corporate Affairs (MCA) vide a notification dated 30th January, 2020 has amended Rule 12 of Companies (Accounts) Rules, 2014 to insert a new sub-rule (1A) which makes it mandatory for every Non-Banking Financial Company (NBFC) that comply with Indian Accounting Standards (Ind AS) to file their financial statements with the Registrar together with Form AOC-4 NBFC (Ind AS) and the consolidated financial statements, if any, with Form AOC-4 CFS NBFC (Ind AS).

The MCA has also annexed the Forms for filing of financial statements (or consolidated financial statements as the case may be) and other documents with the Registrar in the said notification.

The Central Government earlier had made amendments to Schedule III of the Companies Act, 2013 to insert Division III relating to preparation of financial statements for NBFC complying with Ind AS and accordingly necessary changes have been made through the new forms for filing purposes.
