Netherlands Eases Top-Up Tax Penalties and prepares for DAC8/DAC9

The measure should be viewed as a penalty safety net rather than a filing or payment deferral. The 31 August 2026 statutory deadline remains in force, and interest continues to accrue on any top-up tax paid late. In-scope groups should therefore continue to prioritise timely completion of the GIR, as the Dutch top-up tax return and payment depend directly on the underlying GIR data. Any international data-exchange, information-availability or system-related delays should be documented as they arise, particularly where the temporary relief may ultimately need to be relied upon.

It does not cover the separate notification obligation or the DAC8/DAC9 information-reporting penalties, which are being strengthened in parallel. Businesses within scope should accordingly build their compliance timelines around the 31 October 2026 cut-off.
