MCA clarifies, spending CSR funds on ‘Har Ghar Tiranga’ campaign related activities, as ‘eligible CSR activity’

In view of awakening the feeling of patriotism in the hearts of people and to promote awareness about the Indian National Flag, Ministry of Corporate Affairs (MCA) vide its General Circular No. 08/2022 dated 26.07.2022 has clarified that spending of CSR funds for activities related to the campaign ‘Har Ghar Tiranga’, such as mass scale production and supply of the National Flag, outreach and amplification efforts and other related activities, are eligible CSR activities.
The said activities shall be construed as eligible CSR activities under item no. (ii) of Schedule VII of the Companies Act, 2013 pertaining to “promotion of education relating to culture”.
MCA has also clarified that ‘Har Ghar Tiranga’ is a campaign under the aegis of “Azadi Ka Amrit Mahotsav”, aimed at invoking the feeling of patriotism in the hearts of the people and promoting awareness about the Indian National Flag and also to encourage people to bring home the national flag and hoist it to mark the 75th year of India’s independence.
MCA also states that the companies may undertake the aforesaid activities, subject to fulfillment of the Companies (CSR Policy) Rules, 2014 and related circulars/ clarifications issued by the Ministry, from time to time.
The above circular was issued with the approval of competent authority.
